Resume Screener is an AI-powered platform operated by SD IT Support Ltd that analyzes and ranks uploaded resumes against job-specific criteria. Our Service includes:

  • Temporary Processing: Resume content is processed immediately via AI, not stored long-term
  • Results Delivery: Analysis results are provided to you for your hiring decisions
  • Privacy-First: Our audit logs contain no personal information from resumes
  • You Control Data: You decide what to upload and are responsible for candidate consent

2. AI Analysis Disclaimer and Limitations

Our service uses artificial intelligence technology which, while sophisticated, has inherent limitations:

  • No Guarantee of Accuracy: AI analysis may produce incorrect, incomplete, or inconsistent results. Resume rankings and scores should be treated as guidance only, not definitive assessments.
  • Professional Judgment Required: Our AI analysis is designed to assist your decision-making process, not replace human judgment. You must conduct your own evaluation of candidates.
  • Variable Performance: AI performance may vary based on resume formatting, content quality, job criteria complexity, and other factors beyond our control.
  • Best Effort Service: While we strive to provide accurate and useful analysis, we cannot guarantee that our AI will correctly interpret or match all resume content to your job requirements.

🎯 Your Responsibility for Hiring Decisions

  • Final Decision Authority: You remain solely responsible for all hiring decisions, candidate selection, and employment outcomes.
  • Due Diligence: You must verify AI analysis results through interviews, reference checks, and other standard hiring practices.
  • Legal Compliance: You must ensure your hiring process complies with all applicable employment laws and anti-discrimination regulations.
  • No Liability for AI Errors: SD IT Support Ltd accepts no responsibility for hiring decisions based on AI analysis results, including any errors, omissions, or mismatches.

3. User Accounts and Registration

  • You must be at least 18 years old to use our Service
  • You must provide accurate registration information
  • You are responsible for maintaining account security
  • You must notify us of any unauthorized account access
  • One account per user; multiple accounts are prohibited

4. Credits and Pricing System

5. Automatic Refund Policy

We automatically provide proportional refunds for processing failures:

  • Processing Failure: Full refund if no resumes are successfully processed
  • Partial Processing: Proportional refund for unprocessed resumes
  • Technical Issues: Automatic refund for system errors or timeouts
  • Transparent Formula: Refund = (Cost per Resume) × (Unprocessed Resumes)

6. Data Controller Responsibilities

⚠️ Your Legal Obligations as Data Controller

When you upload resumes, YOU are the data controller for candidate data. You must:

  • Obtain Consent: Get explicit consent from candidates before uploading their resumes
  • Inform Candidates: Tell candidates their data will be processed by Resume Screener and OpenAI
  • Have Legal Basis: Ensure lawful basis for processing under GDPR, CCPA, or applicable laws
  • Handle Rights Requests: Respond to candidate requests for access, correction, or deletion
  • Purpose Limitation: Use data only for hiring purposes disclosed to candidates
  • Data Retention: Manage how long you retain candidate data and processing results

7. Service Limitations and Availability

  • Service availability is not guaranteed 24/7
  • We may perform maintenance that temporarily affects service
  • Processing times may vary based on system load
  • File size and format limitations apply (PDF/DOCX, reasonable file sizes)
  • Batch processing may have queue delays during high usage

8. Prohibited Uses

🚫 You May Not:

  • Upload resumes without proper candidate consent
  • Use the service for any illegal or discriminatory purposes
  • Overload our systems with excessive requests
  • Share your account credentials with others
  • Upload malicious files or attempt to hack our systems

9. Limitation of Liability

Our service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, SD IT Support Ltd disclaims all liability for:

  • • Inaccurate, incomplete, or misleading AI analysis results
  • • Hiring decisions made based on our analysis or recommendations
  • • Any discrimination, bias, or unfair treatment arising from AI analysis
  • • Lost opportunities, damages, or costs resulting from service use
  • • Technical errors, system downtime, or data processing failures

You acknowledge that AI technology has limitations and agree that you remain solely responsible for all hiring decisions, candidate evaluation, and compliance with employment laws.

10. AI Bias and Discrimination Disclaimer

  • Bias Awareness: AI systems may exhibit biases based on training data and algorithmic design. Resume analysis results may unintentionally reflect societal biases.
  • Your Responsibility: You must ensure your hiring practices comply with all applicable anti-discrimination laws, regardless of AI analysis results.
  • Human Oversight Required: AI results must be supplemented with human judgment to prevent discriminatory hiring outcomes.
  • Protected Characteristics: Do not use our service to discriminate based on race, gender, age, religion, disability, or other protected characteristics.

11. Account Termination

  • Voluntary Termination: You may close your account at any time through account settings
  • Termination for Violation: We may suspend or terminate accounts for Terms violations
  • Data Deletion: Account closure triggers deletion of your data within 30 days
  • Unused Credits: No refunds for unused credits upon account termination
  • Survival: Limitation of liability and indemnification clauses survive termination

12. Indemnification

You agree to indemnify and hold harmless SD IT Support Ltd from any claims, damages, or losses arising from:

Important: AI results are guidance only. You remain responsible for ensuring fair, legal, and non-discriminatory hiring practices in your jurisdiction.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the English courts. For users in other jurisdictions, local mandatory consumer protection laws and employment regulations may also apply and take precedence where required by law.

15. Severability and Force Majeure

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control
  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and SD IT Support Ltd
